On 19 April, ALFI responds to ESMA’s consultation on the draft common guidelines on reverse solicitation under the Market in Crypto Assets (#MiCA). In our response to this consultation, ALFI generally agrees with the proposed content of the guidelines. We appreciate the underlying purpose of these guidelines is to foster investor protection and we are in favour of the proposed regulatory convergence with the corresponding provisions under #MiFID II. On 19 April 2024, ALFI responds to ESMA’s consultation on the draft common guidelines on the conditions and criteria for the qualification of #crypto-assets as financial instruments under the Market in Crypto Assets (#MiCA). The proposed guidelines aim at providing guidance on the qualification of crypto-assets as financial instruments that national competent authorities and market participants should consider, so as to foster convergence in the local transposition across the EU, regarding the classification of crypto-assets as financial instruments. ALFI, together with LuxCMA - Luxembourg Capital Markets Association, ACA Luxembourg, ABBL, and LPEA - Luxembourg Private Equity & Venture Capital Association recognise the challenges businesses face in opening accounts. Aiming at raising awareness on this issue, we joined efforts to organise a training session on April 16th, 2024. The session aimed to provide bankers and compliance officers with insights into navigating Luxembourg's financial landscape, covering the regulatory framework, compliance best practices, and emerging trends in securitisation and fund structures. The about 50 Attendees benefited from expert insights and meaningful exchanges. “This event has contributed to raising awareness for professionals having to work with securitisation and specific fund structures. ALFI is happy to have collaborated with other associations in facilitating this dedicated event to bankers and compliance officers in credit institutions.
